Terms of Service
The deal
Textcade is a game, operated by JAZZKONNEN LLC. By playing it you agree to these terms. If you don't agree, don't use the app.
License
You get a personal, non-exclusive, non-transferable license to play Textcade on any Apple-branded device you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow. You may not copy, modify, reverse-engineer, or redistribute the app or its content.
Accounts
An anonymous account is created for you automatically to back up progress; you may optionally connect Sign in with Apple. You're responsible for the device access that controls your account. You can delete your account and its server data at any time from inside the app.
Virtual items and currency
Coins, XP, pieces, gear, and any other in-game items are virtual. They have no cash value, are not redeemable for money, and can't be transferred or sold. Purchased items are a license to use those items in the game, not property. Virtual balances may be adjusted or reset to fix bugs or abuse.
Coins are not earned by playing. Playing Textcade earns XP. Coins come from a coin pack, from a Textcade Club membership, or from a rung of the season track — never from a run. XP is earned by playing and is not purchasable.
Subscriptions and purchases
Textcade Club is an auto-renewing monthly subscription. It costs $9.99 per month in the United States; the price in other storefronts is set by Apple's local pricing and is shown to you before you buy. It includes a coin grant each period and removes forced ads.
It renews automatically at the end of every monthly period, and keeps renewing until you cancel. To cancel, go to Settings → your Apple ID → Subscriptions at least 24 hours before the current period ends. Deleting the app does not cancel a subscription.
Coin packs are one-time purchases of a consumable in-game currency. Their prices are shown in the app before you buy.
Payment is charged to your Apple Account. Apple handles all billing, renewals, and refunds for everything bought inside Textcade — we cannot issue a refund ourselves. Refund requests go to Apple Support.
The Season Pass is bought with coins, not money. It is not a purchase from Apple and it is not a subscription; it is spending an in-game balance you already hold.
Fair play
Don't cheat, exploit bugs for advantage, disrupt the service, or interfere with other players. We may suspend or terminate accounts that do.
Availability
Textcade's online features (progress backup, sync, purchases) are provided as-is and may change, be interrupted, or be discontinued. The core game works offline.
Live head-to-head play depends on Apple's Game Center. If Game Center is unavailable, or you are not signed in to it, that mode will not work — the rest of the game still does.
Disclaimer & liability
To the maximum extent permitted by law, Textcade is provided "as is" without warranties of any kind, and our total liability for any claim related to the app is limited to the amount you paid us in the past twelve months.
Apple's part in this
These terms are between you and JAZZKONNEN LLC, not Apple. Apple is not a party to them. We — not Apple — are responsible for Textcade and for everything in it.
Support is ours. If you need help, write to the address at the bottom of this page. Apple has no obligation to provide any maintenance or support for Textcade.
Warranty is ours. If Textcade fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund what you paid for the app. That refund is the whole of Apple's warranty obligation. To the maximum extent the law allows, any other claim, loss, liability, cost or expense that follows from a failure to meet a warranty is ours, not Apple's.
Claims are ours. We, not Apple, answer any claim you or anyone else makes about Textcade or about your use of it — product liability, any claim that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law included.
Infringement claims are ours. If a third party claims that Textcade, or your use of it, infringes their intellectual property, we — not Apple — will investigate, defend, settle and discharge that claim.
Apple can enforce these terms. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple gains the right to enforce them against you, and is deemed to have accepted that right.
Where you may use Textcade
By using Textcade you confirm that you are not in a country under a U.S. Government embargo, or one the U.S. Government has designated as supporting terrorism, and that you are not on any U.S. Government list of prohibited or restricted parties.
Third-party terms
You must also keep to the terms of any third-party service Textcade uses or runs on — your wireless carrier's plan, and Apple's own Media Services and Game Center terms among them.
Who we are and which law applies
Textcade is operated by JAZZKONNEN LLC, a New York limited liability company. These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
Changes
We may update these terms; the current version always lives at this address with its effective date. Continuing to play after a change means you accept the updated terms.
